Our website and the materials on it or provided to you through them are protected by copyright, trademark and/or other intellectual property rights and laws throughout the world and are owned by or are licensed to The Castle Country Club and/or third parties. You are permitted to display the materials on our website on a computer screen and to download and print a hard copy for your personal use provided you do not alter or remove any of the content or any part of our website without our express permission to do so and that you do not change or delete any copyright, trademark or other proprietary notices.

You agree not to use our website or any of the materials on them for any:

  • unlawful purpose or in contravention of applicable law
  • commercial exploitation without our prior written consent
  • any purpose or in any manner that may give a false or misleading impression of us, our staff or our services.

IN THE EVENT THAT YOU DO NOT COMPLY WITH THE ABOVE RESTRICTIONS, ANY PERSON AFFECTED BY YOUR ACTIONS MAY BRING A CLAIM AGAINST YOU AND/OR THE CASTLE COUNTRY CLUB LTD. WE WILL PURSUE A CLAIM AGAINST YOU FOR ANY LOSSES AND COSTS (INCLUDING LEGAL COSTS) WE MAY SUFFER AS A RESULT OF YOUR ACTIONS.

You agree and undertake that you own the rights in any materials you submit to us via the Website or otherwise and/or that you have obtained any relevant permission to use them.

We do not give any assurance that the materials provided or available to you on or through our website are suitable for your requirements or that they will be secure, error or virus free and we will have no liability in respect of those materials.

Our website is provided free of charge and we make no guarantee that they will be uninterrupted or error free. We reserve the right to modify, suspend or withdraw the whole or any part of our website or any of their content at any time without notice and without incurring any liability.

The Castle Country Club may monitor activity and content on our website and may take any action we consider appropriate if we suspect you may be in breach of these Terms and Conditions including suspending, attaching conditions to or terminating your access and/or notifying the authorities or relevant regulators of your activities.

Internet transmissions are never completely private or secure and there is a risk, therefore, that any message or information you send to us from our website may be intercepted and potentially read by others. We will have no liability in respect of any transmissions you send to us, and you do so entirely at your own risk.

IF YOU CHOOSE TO ACCESS THE WEBSITE FROM OUTSIDE ENGLAND AND WALES, YOU DO SO AT YOUR OWN RISK AND ARE RESPONSIBLE FOR COMPLIANCE WITH THE LAWS OF YOUR JURISDICTION.

11. Liability For Our Mistakes

WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL LOSS, DAMAGE OR EXPENSES (INCLUDING WITHOUT LIMITATION ANY LOSS OF MATERIALS, INTERRUPTION OF SERVICE OR WASTED EXPENDITURE) HOWSOEVER ARISING OUT OF YOUR USE OF THIS WEBSITE, WHERE:

  • (A) THERE IS NO BREACH OF A LEGAL DUTY OF CARE OWED TO YOU BY US;
  • (B) THE LOSS OR DAMAGE IS NOT A REASONABLY FORESEEABLE RESULT OF ANY SUCH BREACH; OR

THE FOREGOING LIMITATIONS SHALL APPLY REGARDLESS OF THEORY UNDER WHICH SUCH CAUSE OF ACTION IS BROUGHT, WHETHER IN CONTRACT, TORT, WARRANTY OR OTHERWISE. NOTHING IN THESE TERMS AND CONDITIONS EXCLUDES OR LIMITS OUR LIABILITY FOR FRAUDULENT MISREPRESENTATION OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.

12. Indemnity

You agree to indemnify and hold The Castle Country Club, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Website and/or breach of any of our terms and conditions including these Terms.

13. Third Party Rights

Nothing in these Terms and Conditions is intended to nor shall it confer a benefit on any third party under the Contracts (Rights of Third Parties) Act 1999 and a person who is not a party to these Terms and Conditions has no rights to enforce them.

14. Waiver

No delay or decision not to enforce rights under these terms and conditions will constitute a waiver of the right to do so and will not affect rights in relation to any subsequent breach.

15. Invalidity

If any of these Terms are found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other conditions which shall remain in full force and effect.

If any of these Terms are found to be invalid or unenforceable but would cease to be invalid or unenforceable if some parts of the provision were deleted, the provision in question shall apply with such modification as may be necessary to make valid and enforceable.

16. Governing Law

These Terms and Conditions are subject to the laws of England and Wales and each of us hereby submits to the exclusive jurisdiction of the English and Welsh courts.

WE RESERVE THE RIGHT TO CHANGE THESE TERMS AND CONDITIONS AT ANY TIME. THE NEW VERSION WILL BE POSTED ON THIS WEBSITE AND WILL TAKE EFFECT IMMEDIATELY UPON POSTING.

IF YOU USE THE WEBSITE AFTER THE NEW TERMS AND CONDITION HAVE COME INTO EFFECT, YOU WILL BE INDICATING YOUR AGREEMENT TO BE BOUND BY THESE NEW TERMS AND CONDITIONS.

 

Membership Agreement

1. Membership Fees and Payments

Membership fees are payable to Castle Country Club Ltd by Direct Debit through ClubRight Pay.

ClubRight Pay acts solely as the payment administration and collection provider on behalf of Castle Country Club Ltd. Any matters relating to membership, facilities, services or the operation of the Club remain between the member and Castle Country Club Ltd.

Membership fees are charged monthly in advance and will continue to be collected until the membership has been cancelled in accordance with the cancellation terms below.

In order to administer a membership, Castle Country Club may provide ClubRight Pay with relevant updates to the information contained within the member's membership agreement. Information will be handled in accordance with the applicable privacy notices.

2. Changes to Membership Fees

Castle Country Club Ltd may change its membership fees.

Members will be provided with at least two months' notice of any increase to their regular membership fee.

3. Cancellation of Direct Debit Memberships

Direct Debit memberships operate on a rolling monthly basis and require a minimum of 30 days' written notice to cancel.

Cancellation requests must be submitted in writing to Castle Country Club. The 30-day notice period begins on the date the Club receives the written cancellation request.

Castle Country Club will confirm receipt of the cancellation request and provide the member with their confirmed final membership date.

4. Direct Debit Payments During the Cancellation Period

Membership fees are collected monthly in advance.

If a scheduled Direct Debit payment falls within the member's 30-day cancellation notice period, that payment will still be collected in full.

The membership will then remain active until the end of the membership period covered by that final payment.

Monthly Direct Debit membership fees will not ordinarily be calculated, refunded or reduced on a daily pro-rata basis simply because the 30-day notice period expires part-way through a paid membership period.

The member will continue to have access to the Club and the benefits included within their membership until their confirmed membership end date.

Example:

A member's Direct Debit is collected on the 1st of each month.

The member submits a cancellation request on 16th September.

Their 30-day notice period therefore extends into October. As the scheduled Direct Debit on 1st October falls within the notice period, the October payment will still be collected in full.

The member will remain an active member for the period covered by that October payment and their membership will end on 31st October.

No further Direct Debit will then be collected on 1st November.

5. Cancelling the Direct Debit Instruction

Members should not cancel their Direct Debit instruction with their bank until Castle Country Club has confirmed their final payment and membership end date.

Cancelling a Direct Debit instruction with the bank does not, by itself, constitute cancellation of the membership agreement.

The member remains responsible for any membership fees properly due under this agreement during the applicable notice and membership period.

6. Unpaid Membership Fees

If a membership payment becomes overdue or remains unpaid, Castle Country Club may suspend access to the Club while the outstanding amount is investigated or recovered.

Where a monthly membership charge remains unpaid one month after it became due, Castle Country Club may terminate the membership agreement by giving notice to the member.

Termination of the membership does not remove responsibility for any membership fees that became properly due before termination.

7. Cancellation by Castle Country Club

Castle Country Club Ltd may terminate a membership by providing the member with no less than one month's notice.

The Club reserves the right to suspend or terminate a membership sooner where there are exceptional circumstances, including serious breaches of Club rules, inappropriate behaviour, misuse of facilities, threats to the safety or wellbeing of members or staff, fraud, or other serious misconduct.

8. Notices and Communication

Cancellation requests and other formal membership notices should be made in writing.

Members are responsible for ensuring that Castle Country Club holds their current contact details.

Notices from Castle Country Club may be sent using the most recent postal address or email address provided by the member.

9. Membership and Use of Facilities

Members and any other persons included within their membership must comply with Castle Country Club's rules and reasonable instructions relating to the safe and appropriate use of the Club and its facilities.

Members use the Club's facilities at their own risk, subject always to Castle Country Club Ltd's legal responsibilities.

Nothing within this Membership Agreement excludes or limits any liability which cannot lawfully be excluded or limited.

10. Disputes

If a member has a concern or dispute relating to their membership, they should contact Castle Country Club in the first instance so that the matter can be investigated and, where possible, resolved.

Nothing within these terms affects a member's statutory consumer rights.
